Mary Mobile Return, Refund, Security, Chargeback & Arbitration Policy

Important Notice

Mary Mobile currently offers VoIP and business communications services, along with retail products and accessories.

Mary Mobile is not currently offering or selling cellular/mobile wireless service plans.

VoIP and other telecommunications services offered by Mary Mobile may be governed by separate service agreements, acceptable-use policies, service limitations, telecommunications terms, cancellation provisions, and other applicable service-specific policies.

This Return & Refund Policy primarily governs physical retail merchandise and accessories. Where a Mary Mobile VoIP or telecommunications service is involved, the applicable service-specific agreement controls to the extent it conflicts with this merchandise return policy.

Because Mary Mobile provides communications and telecommunications services and operates within the communications sector, Mary Mobile operates in a sector recognized as part of the United States critical-infrastructure environment. Mary Mobile therefore takes security, privacy, fraud prevention, loss prevention, operational continuity, customer verification, protection of company systems, and personnel safety seriously.

By purchasing merchandise from Mary Mobile, the customer agrees to this Policy.

All merchandise returns require prior written authorization.

Return Eligibility

Most new, unused products may be eligible for return within thirty (30) days of delivery unless otherwise stated on the applicable product page.

To qualify:

  • Merchandise must be new, unused, and resalable;
  • Original packaging, manuals, accessories, cables, components, documentation, and included materials must be returned;
  • The product must not show signs of installation, activation, use, abuse, alteration, modification, accidental damage, or excessive handling;
  • Proof of purchase must be provided;
  • A Return Merchandise Authorization (“RMA”) must be obtained before merchandise is returned.

A return request does not automatically guarantee a refund.

Mary Mobile may inspect, authenticate, test, verify, and identify returned merchandise before approving a refund.

Return Merchandise Authorization Required

Customers must obtain an RMA before returning merchandise.

Return instructions may specify:

  • Exact return address;
  • Shipping method;
  • Packaging requirements;
  • Documentation requirements;
  • Serial-number verification;
  • IMEI or MAC-address verification;
  • Supplier or manufacturer instructions;
  • Return deadline.

Merchandise sent without authorization may be refused, returned to the sender, held pending disposition instructions, or otherwise handled under this Policy.

Receipt, signature, forwarding, storage, or physical possession of unauthorized merchandise does not constitute acceptance of the return.

Restocking & Cancellation Fee

Unless prohibited by law or otherwise stated in writing, approved discretionary returns, cancellations, refused deliveries, unauthorized returns, reseller violations, and other eligible transactions may be subject to a restocking or cancellation fee of up to fifteen percent (15%) of the purchase price.

The fee may help compensate Mary Mobile for:

  • Return processing;
  • Inspection;
  • Testing;
  • Device verification;
  • Repackaging;
  • Inventory handling;
  • Supplier charges;
  • Payment-processing costs;
  • Administrative work;
  • Fraud or risk review;
  • Compliance work;
  • Additional handling.

A manufacturer, distributor, supplier, or fulfillment partner may separately impose a return, restocking, processing, cancellation, or similar fee. Where permitted by law, such amounts may also be deducted from any refund.

The Mary Mobile restocking or cancellation fee generally will not apply where Mary Mobile confirms that it shipped materially incorrect merchandise or merchandise arrived materially damaged or defective through no fault of the customer.

Restocking and cancellation fees are separate from shipping, storage, security, recovery, collection, processor, or other lawful costs.

Return Shipping

Unless a return is directly caused by Mary Mobile’s error or a confirmed defect for which Mary Mobile accepts responsibility, customers are responsible for:

  • Return shipping;
  • Packaging;
  • Tracking;
  • Insurance where appropriate;
  • Carrier surcharges;
  • Supplier or manufacturer return transportation;
  • Other reasonable return expenses.

Original shipping, expedited shipping, delivery, installation, setup, merchandise configuration, and similar charges are non-refundable unless required by law.

Mary Mobile is not responsible for merchandise lost, stolen, or damaged before reaching the authorized return destination.

Manufacturer & Supplier Policies

Many products sold by Mary Mobile may be fulfilled by manufacturers, distributors, suppliers, or fulfillment partners.

Products may:

  • Require supplier authorization;
  • Require manufacturer authorization;
  • Require inspection;
  • Be subject to manufacturer-specific restrictions;
  • Be covered by a manufacturer’s warranty instead of a retail return;
  • Carry additional restocking or processing charges;
  • Become non-returnable after opening, installation, activation, configuration, or use.

Mary Mobile may assist with the appropriate return or warranty process but does not guarantee supplier or manufacturer approval.

Defective, Damaged or Incorrect Products

Customers should inspect merchandise promptly after delivery.

If merchandise arrives damaged, materially defective, or materially incorrect, contact Mary Mobile as soon as reasonably possible.

Mary Mobile may require:

  • Photographs;
  • Videos;
  • Serial numbers;
  • IMEI numbers;
  • MAC addresses;
  • Packaging photographs;
  • Shipping labels;
  • Diagnostic information;
  • Other documentation reasonably necessary to investigate.

Customers should preserve merchandise, packaging, labels, accessories, and supporting materials until Mary Mobile completes its review.

Depending upon the circumstances, Mary Mobile may replace merchandise, arrange warranty service, authorize a return, issue an appropriate refund, or provide another reasonable resolution.

Product Identification & Anti-Swapping

Mary Mobile may record product-identification information before shipment.

Such information may include:

  • Serial numbers;
  • IMEI numbers;
  • MAC addresses;
  • Model numbers;
  • Hardware identifiers;
  • Security identifiers;
  • Manufacturer identifiers;
  • Photographs or other identifying characteristics.

Returned merchandise must match the merchandise originally supplied by Mary Mobile.

Returning substituted, counterfeit, materially different, altered, or differently identified merchandise may result in:

  • Rejection of the return;
  • Denial of a refund not otherwise legally required;
  • Account restriction;
  • Collection activity where a lawful balance exists;
  • Preservation of evidence;
  • Referral for investigation where appropriate.

Installed, Activated, Provisioned & Configured Electronics

Electronic equipment may become non-returnable where it has been materially:

  • Installed;
  • Activated;
  • Provisioned;
  • Registered;
  • Configured;
  • Enrolled;
  • Modified;
  • Damaged;
  • Used beyond reasonable inspection.

Phones, VoIP devices, ATAs, routers, gateways, networking equipment, and similar products that have been specially programmed, provisioned, registered, or configured for a customer may require deprovisioning, resetting, reconfiguration, or other technical work before return.

Where permitted by law, reasonable deprovisioning, reconfiguration, testing, or administrative costs may be deducted from an otherwise eligible refund.

Activation Locks, Accounts & Security Controls

Before returning electronics, customers must remove, where applicable:

  • Apple Activation Lock;
  • Google or Android account locks;
  • MDM enrollment;
  • Device-management profiles;
  • User accounts;
  • Passwords;
  • PINs;
  • Security keys;
  • Other customer-controlled restrictions that prevent testing or resale.

A device that cannot reasonably be tested, reset, or resold because of a customer-controlled security restriction may be rejected until the restriction is removed.

Customer Data

Customers are responsible for backing up and removing personal, confidential, proprietary, or other customer data before returning equipment.

Mary Mobile may erase or factory-reset returned equipment as part of inspection, testing, refurbishment, or resale.

Except where otherwise required by law, Mary Mobile is not responsible for customer data left on returned equipment.

Lithium Batteries & Regulated Shipping

Customers must comply with all applicable carrier, transportation, and hazardous-material requirements when returning batteries or battery-powered products.

Do not ship a swollen, punctured, leaking, burned, overheating, visibly damaged, recalled, or otherwise potentially hazardous lithium battery without first obtaining instructions from Mary Mobile.

Mary Mobile may require a specialized carrier, packaging method, local disposition process, or manufacturer procedure for potentially hazardous merchandise.

Lost, Stolen & Non-Delivery Claims

Mary Mobile may investigate claims that merchandise was lost, stolen, or not delivered.

For high-value or suspicious claims, Mary Mobile may request reasonably relevant documentation, including:

  • Identity verification;
  • Carrier investigation;
  • Delivery records;
  • Signature records;
  • Photographs;
  • Written statement regarding non-receipt;
  • Police or incident report where reasonably appropriate;
  • Other information necessary to investigate.

The requirement for additional information does not eliminate any customer right that cannot legally be waived.

Evidence of Delivery

Mary Mobile may rely upon competent evidence of delivery, including:

  • Carrier tracking;
  • Delivery scans;
  • Signatures;
  • Delivery photographs;
  • GPS or location information supplied by the carrier;
  • Access-point or pickup records;
  • Customer communications acknowledging receipt;
  • Other reliable delivery evidence.

Refurbished, Used & Open-Box Merchandise

Products identified as refurbished, renewed, open-box, pre-owned, used, demonstration, or similar merchandise are not represented as factory-new merchandise unless expressly stated otherwise.

Such merchandise may have separate return, warranty, cosmetic-condition, packaging, or manufacturer requirements.

Minor cosmetic variation consistent with the disclosed condition does not necessarily constitute a defect.

Promotional Bundles, Discounts & Free Merchandise

Where an order includes:

  • Bundled products;
  • Promotional discounts;
  • Free gifts;
  • Buy-one-get-one promotions;
  • Package pricing;
  • Conditional rebates;
  • Similar incentives;

the customer’s refund may be recalculated based upon the merchandise actually retained.

If promotional merchandise is not returned, Mary Mobile may deduct its stated or reasonable value from the refund where permitted by law.

Taxes, Government Charges & Regulatory Fees

Refundable sales taxes will be handled in accordance with applicable law.

Taxes, government assessments, telecommunications-related fees, E911 charges, regulatory assessments, usage charges, number-porting charges, service setup charges, or similar amounts associated with VoIP or communications services may be subject to separate service-specific terms.

Nothing in this merchandise return policy guarantees refundability of a telecommunications tax, governmental charge, service fee, or third-party assessment.

Export Controls, Sanctions & Restricted Transactions

Mary Mobile may reject, hold, investigate, or cancel transactions where it reasonably believes a transaction may involve:

  • A prohibited destination;
  • A sanctioned or restricted person or entity;
  • Export-control restrictions;
  • Unauthorized export or re-export;
  • Attempts to evade geographic restrictions;
  • False end-user information;
  • Other compliance concerns.

Customers are responsible for complying with applicable export, sanctions, customs, and trade-control laws.

Mary Mobile may require additional end-user, business, shipping, or identity verification where reasonably appropriate.

Resellers, Brokers & Commercial Purchasers

If you intend to purchase Mary Mobile merchandise for resale, redistribution, brokerage, export, or other commercial resale activity, contact Mary Mobile Customer Support before placing an order.

Mary Mobile may require reseller registration, business verification, tax documentation, identity verification, supplier authorization, or other reasonable onboarding requirements.

Mary Mobile may impose:

  • Quantity limits;
  • Customer limits;
  • Household limits;
  • Business limits;
  • Reseller restrictions;
  • Geographic restrictions;
  • Product-specific restrictions.

Attempts to circumvent restrictions through multiple accounts, names, businesses, addresses, payment methods, third parties, or split transactions may result in cancellation, account restrictions, additional verification, or refusal of future business.

Unregistered or unauthorized resellers may incur reseller, administrative, compliance, processing, cancellation, or handling fees up to the maximum amount permitted by applicable law, where such charges are legally enforceable and reasonably related to the transaction or costs caused by the purchaser’s conduct.

These charges are separate from applicable restocking, cancellation, shipping, recovery, security, collection, or other lawful costs.

Order Acceptance, Cancellation & Refusal of Service

Mary Mobile reserves the right to accept, reject, limit, hold, modify, or cancel any retail merchandise order at any time, for any lawful reason or for no stated reason, to the fullest extent permitted by applicable law.

An order confirmation, payment authorization, temporary payment capture, or beginning of processing does not guarantee fulfillment.

Mary Mobile may cancel or refuse an order due to:

  • Pricing or listing errors;
  • Inventory problems;
  • Supplier restrictions;
  • Quantity limitations;
  • Reseller restrictions;
  • Suspected fraud;
  • Payment risk;
  • Chargeback history;
  • Return-abuse history;
  • Identity or address verification;
  • Security concerns;
  • Export, sanctions, regulatory, or compliance concerns;
  • Shipping limitations;
  • Supplier cancellation;
  • Abusive, deceptive, threatening, or disruptive conduct;
  • Attempts to circumvent Mary Mobile policies;
  • Excessive commercial or financial risk;
  • Any other lawful business reason.

Mary Mobile is not obligated to disclose confidential security procedures, risk criteria, fraud controls, supplier requirements, or threat-assessment methods except where legally required.

If Mary Mobile cancels an order before merchandise is supplied, amounts legally required to be returned will be refunded or released, subject to independently lawful charges or obligations.

Nothing in this provision permits unlawful discrimination.

Unauthorized Returns & Unauthorized Delivery Locations

Merchandise may be returned only to the exact address provided by Mary Mobile in the applicable RMA or written return instructions.

Unless specifically authorized in writing for a particular return, the following are not return locations:

  • Personal residences;
  • Personal mailboxes;
  • Mail centers;
  • Commercial mailbox services;
  • Registered-agent addresses;
  • Attorneys’ offices;
  • Law firms;
  • Virtual offices;
  • Corporate filing addresses;
  • Forwarding addresses;
  • Supplier or manufacturer locations.

This applies to addresses associated with Mary Mobile owners, officers, employees, contractors, representatives, attorneys, or their families.

The appearance of an address in a corporate filing, public record, internet search result, data-broker database, court record, directory, prior correspondence, shipping record, or other source does not make it an authorized Mary Mobile return location.

A customer who uses an unauthorized location may be responsible, to the fullest extent permitted by law, for shipping, forwarding, retrieval, storage, handling, administration, carrier charges, security, disposal, and other documented expenses, together with an administrative or security fee up to the maximum amount permitted by law.

Disposition of Unauthorized Merchandise

Mary Mobile may request written disposition instructions for unauthorized merchandise.

If the sender does not provide valid instructions and arrange payment of applicable expenses within seven (7) calendar days after notice, Mary Mobile may, to the fullest extent permitted by applicable law:

  • Return the merchandise at the sender’s expense;
  • Sell or resell it;
  • Liquidate it;
  • Donate it;
  • Give it away;
  • Recycle it;
  • Destroy it;
  • Discard it;
  • Otherwise dispose of it as reasonably appropriate.

Where permitted by law, merchandise disposed of pursuant to this provision may not qualify for refund or credit.

Critical Infrastructure, Security & Personal Addresses

Mary Mobile is committed to maintaining a safe, secure, healthy, and professional business environment.

Because Mary Mobile provides VoIP and communications services and operates within the communications sector, Mary Mobile operates within a sector recognized as part of the United States’ critical-infrastructure environment. Accordingly, Mary Mobile takes security, privacy, fraud prevention, loss prevention, operational continuity, system protection, and personnel safety seriously.

Mary Mobile may implement heightened:

  • Customer verification;
  • Business verification;
  • Transaction monitoring;
  • Fraud screening;
  • Address verification;
  • Security review;
  • Record preservation;
  • Access controls;
  • Supplier verification;
  • Carrier verification;
  • High-risk transaction review.

Personal residential addresses and personal mailboxes belonging to Mary Mobile owners, officers, employees, contractors, representatives, attorneys, or family members are not Mary Mobile business addresses and must not be used for returns, shipments, packages, payments, written demands, or other physical business purposes.

Knowingly using an unauthorized personal or security-sensitive address may result in legally recoverable security, retrieval, forwarding, storage, handling, administrative, loss-prevention, legal, or other expenses, together with an administrative or security fee up to the maximum amount permitted by applicable law.

Mary Mobile may refuse delivery, return merchandise at the sender’s expense, cancel transactions, require enhanced verification, restrict future business, preserve evidence, refer appropriate security matters to competent authorities, or pursue other lawful remedies.

This provision does not prohibit reasonable and lawful communication by email, telephone, direct message, or social media, including communication with an owner, officer, employee, representative, or attorney, provided such communication does not become threatening, abusive, harassing, stalking, fraudulent, or otherwise unlawful.

Nothing in this section restricts lawful service of process, subpoenas, court orders, or legally required notices.

Fraud, Return Abuse & Misrepresentation

Mary Mobile may investigate suspected:

  • Fraud;
  • Theft;
  • Return fraud;
  • Product substitution;
  • Serial-number manipulation;
  • False damage claims;
  • False non-delivery claims;
  • False unauthorized-payment claims;
  • Chargeback abuse;
  • Excessive return activity;
  • Reseller circumvention;
  • Other material misuse.

Where lawful, Mary Mobile may preserve and provide relevant evidence to processors, financial institutions, manufacturers, suppliers, carriers, insurers, collection providers, attorneys, dispute-resolution providers, security professionals, or law-enforcement authorities.

Chargebacks & Payment Disputes

Mary Mobile recognizes customers may have legitimate rights to dispute unauthorized transactions, billing errors, or genuine unresolved issues.

Nothing in this Policy eliminates a right that cannot lawfully be waived.

Customers should provide Mary Mobile a reasonable opportunity to resolve merchant-resolvable issues before initiating an external payment dispute.

A chargeback or payment reversal does not automatically extinguish an independently valid contractual obligation, authorize retention of merchandise without payment, or waive other amounts lawfully owed to Mary Mobile.

Chargeback Abuse & Friendly Fraud

Mary Mobile may investigate potential chargeback abuse or friendly fraud, including:

  • False non-delivery claims;
  • False unauthorized-purchase claims;
  • Filing a chargeback while retaining merchandise;
  • Filing a chargeback after receiving a refund;
  • Using a chargeback to evade lawful return or cancellation terms;
  • Product substitution;
  • False condition claims;
  • Materially false documents;
  • Repeated disputes contradicted by transaction records.

Mary Mobile will distinguish legitimate good-faith disputes from documented abuse.

Chargeback Recovery, Administrative & Collection Fees

Where a chargeback occurs and an independently valid, legally enforceable balance remains due, Mary Mobile may assess a chargeback recovery, administrative, dispute-processing, collection, or similar fee up to the maximum amount permitted by applicable law.

Mary Mobile may also recover legally recoverable costs including:

  • Processor charges;
  • Evidence preparation;
  • Administrative personnel time;
  • Shipping;
  • Storage;
  • Retrieval;
  • Security;
  • Collection-agency expenses;
  • Court costs;
  • Service costs;
  • Attorney fees where recoverable;
  • Other documented losses.

Mary Mobile will not impose a punitive charge merely because a customer exercises a legitimate, legally protected dispute right.

Chargebacks & Collections

A payment reversal does not automatically extinguish an independent contractual debt.

Where a legally enforceable balance remains, Mary Mobile may pursue that balance through lawful collection methods.

This may include referral to:

  • Collection agencies;
  • Attorneys;
  • Recovery providers;
  • Civil proceedings;
  • Other lawful recovery processes.

A favorable bank or payment-provider chargeback decision does not necessarily constitute a judicial determination that an independent contractual obligation has been satisfied.

Payment Processor Decisions & Merchant Rights

Mary Mobile’s use of payment processors does not constitute a waiver of independently available contractual or legal rights.

Mary Mobile may lawfully:

  • Contest disputes;
  • Submit evidence;
  • Seek reconsideration;
  • Escalate payment disputes;
  • Invoke contractual procedures;
  • Challenge reserves or restrictions;
  • Pursue arbitration or litigation where available;
  • Change processors;
  • Adopt alternative payment methods;
  • Pursue independent remedies.

Electronic Records & Transaction Evidence

Mary Mobile may preserve electronic records reasonably necessary to document transactions, investigate fraud, defend disputes, comply with legal requirements, and protect its operations.

Records may include, where lawfully maintained:

  • Checkout acceptance records;
  • Order records;
  • Email communications;
  • Text communications;
  • Customer-service communications;
  • Call records;
  • IP information;
  • Device or browser information;
  • Login information;
  • Verification results;
  • Carrier information;
  • Electronic acknowledgments;
  • Transaction timestamps;
  • Other relevant electronic evidence.

Policy Changes

Mary Mobile may modify this Policy from time to time.

Except where applicable law requires otherwise, the version of this Policy in effect when an order is placed will ordinarily govern that transaction.

A later policy change will not ordinarily retroactively reduce a customer’s vested legal rights.

Mary Mobile may apply a later policy where required by law or where the later policy is more favorable to the customer.

Refusal of Future Service

Mary Mobile may, to the fullest extent permitted by law, refuse future merchandise transactions where there is a documented history of fraud, return abuse, product substitution, nonpayment, chargeback abuse, reseller violations, security concerns, or other material misuse.

Mary Mobile is not obligated to continue a commercial relationship merely because it previously accepted an order.

Maximum Amount Permitted by Law

Whenever this Policy authorizes a fee, reimbursement, charge, expense, administrative cost, security assessment, collection amount, or other monetary obligation without specifying a fixed amount, Mary Mobile may assess or pursue that amount up to the maximum amount permitted by applicable law.

Where a stated or calculated amount exceeds the amount legally enforceable, Mary Mobile intends, where legally permitted, that the amount be reduced to the maximum enforceable amount rather than invalidating the underlying obligation.

Governing Law

To the fullest extent permitted by applicable law, this Policy and transactions with Mary Mobile shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles that would require application of another jurisdiction’s law.

The parties intend Delaware law to govern their contractual relationship to the maximum extent legally permissible.

Mandatory federal law and any non-waivable consumer protection required by another applicable jurisdiction remain applicable to the extent legally required.

Binding Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS, INCLUDING THE RIGHT TO HAVE CERTAIN DISPUTES DECIDED IN COURT BY A JUDGE OR JURY.

Except for disputes or remedies that applicable law does not permit to be subjected to mandatory arbitration, the customer and Mary Mobile agree that any dispute, claim, or controversy arising out of or relating to a purchase, return, refund, transaction, payment, chargeback, merchandise, this Policy, or the relationship between the customer and Mary Mobile shall be resolved through final and binding arbitration rather than litigation in court.

The arbitration agreement shall be interpreted and enforced under the Federal Arbitration Act, together with applicable Delaware contract law. Delaware courts have recognized that where an arbitration agreement does not expressly invoke the Delaware Uniform Arbitration Act, the FAA generally governs arbitration-related proceedings. Arbitration Location

Unless applicable law requires otherwise or Mary Mobile and the customer agree to another arrangement, the legal seat of arbitration shall be Dover, Delaware.

Hearings may be conducted remotely, by telephone, videoconference, written submissions, or another method permitted by the applicable arbitration rules.

Where applicable law requires a consumer arbitration to occur in another location or permits the customer to participate from their home jurisdiction, that requirement will control.

Arbitration Administrator and Rules

Arbitration shall be administered by a nationally recognized arbitration provider mutually selected by the parties or, absent agreement, by an arbitration provider or arbitrator selected according to applicable law.

The applicable consumer or commercial arbitration rules shall govern depending upon the nature of the transaction.

Individual Arbitration

To the fullest extent permitted by law, arbitration shall proceed on an individual basis.

Neither party agrees to arbitrate claims on a class, collective, consolidated, or representative basis except where applicable law requires otherwise or both parties expressly agree in writing.

Small Claims

Either party may pursue an eligible individual claim in a small-claims court notwithstanding this arbitration provision, provided the matter remains within that court’s jurisdiction and proceeds individually.

Injunctive and Emergency Relief

Nothing in this arbitration provision prevents either party from seeking temporary or emergency injunctive relief from a court of competent jurisdiction where such relief is legally available and necessary to preserve rights, property, evidence, security, confidential information, or the status quo pending arbitration.

Arbitration Award

The arbitrator may award any individual remedy available under applicable law and the parties’ agreement.

Judgment on an arbitration award may be entered in any court having jurisdiction.

Arbitration Severability

If any portion of this arbitration agreement is determined to be invalid or unenforceable, that portion shall be severed or limited to the maximum extent permitted by law while the remaining arbitration provisions remain effective, except where applicable law requires a different result.

Delaware Forum for Non-Arbitrable Matters

For disputes that are not required to be arbitrated and for proceedings relating to the enforcement of an arbitration agreement or award, the parties agree, to the fullest extent permitted by applicable law, to the appropriate state or federal courts located in Delaware.

Where venue may validly be contractually designated, the parties intend Dover, Delaware to serve as the agreed location for proceedings arising from this Policy.

Nothing in this section overrides a mandatory venue or jurisdiction rule that applicable law prohibits the parties from waiving.

Severability

If any provision, sentence, clause, phrase, fee, remedy, restriction, arbitration provision, or other portion of this Policy is determined to be invalid, illegal, void, or unenforceable, that portion shall be severed, limited, modified, or enforced to the maximum extent legally permissible, and the remainder of the Policy shall remain effective.

The invalidity of one provision does not invalidate the entire Policy.

Where legally permitted, an unenforceable monetary provision shall be reduced to the maximum lawful amount rather than eliminated entirely.

No Waiver & Cumulative Remedies

Mary Mobile’s failure or delay in enforcing any provision does not constitute a waiver.

A waiver concerning one transaction, customer, return, chargeback, or circumstance does not constitute a waiver concerning another.

Exercise of one lawful remedy does not prevent Mary Mobile from pursuing another independently available remedy.

Consumer Rights

Nothing in this Policy eliminates, restricts, or waives any consumer right or remedy that applicable law prohibits the parties from waiving.

Where mandatory applicable law provides greater protections, those protections apply to the extent required.
