Mary Mobile VoIP Service Terms & Conditions
Effective Date: August 12, 2026
PURPOSE AND DEFINITIONS
Mary Mobile provides Session Initiation Protocol (“SIP”) based Voice over Internet Protocol (“VoIP”), cloud communications, telephone-number, messaging, and related communications services.
The customer (“Customer,” “you,” or “your”) desires to purchase and use services offered by Mary Mobile, and Mary Mobile agrees to provide such services subject to these Terms & Conditions, the applicable service order or quote, Mary Mobile’s Acceptable Use Policy, E911 disclosures, and any other applicable service documents.
“Service” means the telecommunications, VoIP, messaging, equipment, software, features, or related services identified in the Customer’s order, quote, service schedule, or other applicable documentation.
“Service Date” means the date Mary Mobile determines that provisioning and required testing of the applicable Service have been completed and the Service is ready for Customer use.
An order submitted through MaryMobile.com does not constitute immediate activation of Service.
1. TERM
1.1 Month-to-Month Service
Unless otherwise stated in a written quote or service order, Mary Mobile VoIP plans are provided on a month-to-month basis with no annual commitment.
The initial service term begins on the Service Date and continues for one month. Service automatically renews for successive one-month periods until canceled in accordance with these Terms.
1.2 Cancellation
Either party may elect not to renew month-to-month Service in accordance with Mary Mobile’s applicable cancellation procedures.
Cancellation does not eliminate responsibility for charges incurred before the effective cancellation date, including usage charges, taxes, regulatory assessments, equipment charges, installation charges, porting charges, or other amounts already incurred.
2. DESCRIPTION OF SERVICES
Mary Mobile, directly or through affiliates, vendors, platform providers, underlying carriers, or telecommunications providers, will provide the Services purchased by Customer.
Services may include:
- VoIP calling
- Hosted PBX services
- Telephone numbers
- Local and toll-free calling
- SMS/MMS messaging
- Call recording
- Call transcription or summarization
- Digital fax
- AI-powered communications features
- Telephone equipment
- Installation and configuration services
- Other communications services offered from time to time
Certain services require separate provisioning, registration, approval, equipment, configuration, or additional charges.
3. SERVICE ORDERS, ACCOUNT CREDIT AND PROVISIONING
3.1 Initial Online Payment
When Customer places an online VoIP service order through Mary Mobile, the amount collected at checkout will be credited in full to Customer’s Mary Mobile telecommunications account.
The online payment is not an additional fee and will be applied toward amounts billed to Customer through Mary Mobile’s telecommunications billing system.
3.2 Additional Charges
The amount collected online may not represent Customer’s complete cost of service.
Additional amounts may include:
- Telecommunications taxes
- E911 charges
- Federal, state or local regulatory fees
- Regulatory recovery charges
- Usage and overage charges
- Telephone numbers
- Toll-free usage
- SMS/MMS registration or campaign charges
- Equipment
- Professional installation
- Cabling
- Configuration or setup work
- Number-porting charges
- Optional features
- Additional products or services
Mary Mobile will communicate applicable additional charges during account setup or through Customer’s telecommunications invoice.

3.3 Provisioning
Service is not activated immediately upon online checkout.
After an order is received, Mary Mobile may contact Customer by telephone and/or email to complete:
- Customer verification
- Billing enrollment
- E911 registration
- Telephone-number assignment
- Number porting
- Messaging registration
- Equipment selection or installation
- Service configuration
- Other provisioning requirements
4. CUSTOMER VERIFICATION / KNOW YOUR CUSTOMER
Mary Mobile maintains customer-verification and Know Your Customer (“KYC”) procedures designed to prevent fraud, unlawful use, unauthorized account creation, and misuse of telecommunications services.
Customer agrees to provide accurate, current and complete information requested by Mary Mobile.
Mary Mobile may request documentation or information sufficient to verify:
- Customer identity
- Business identity
- Service address
- Billing information
- Authorized users
- Ownership or authorization relating to telephone numbers
- Intended use of Service
- Other information reasonably necessary to establish or maintain Service
Mary Mobile may delay, decline, suspend, or cancel an order or Service when required information cannot be verified, where information appears materially inaccurate or fraudulent, or where Mary Mobile reasonably believes activation could expose Mary Mobile or its providers to fraud, abuse, regulatory risk, or financial loss.
5. ACCEPTABLE USE POLICY
By ordering or using Service, Customer agrees to comply with this Acceptable Use Policy.
Mary Mobile may suspend or terminate Service for material violations of this policy, subject to applicable law.
5.1 Lawful Use
Service must be used for lawful purposes and in a manner consistent with its intended use.
Customer shall not use Service to transmit, distribute, receive, store, or facilitate material or communications that:
- Violate applicable federal, state, local, or international law;
- Interfere with telecommunications networks or services;
- Constitute fraud, phishing, spoofing, harassment, or unlawful solicitation;
- Violate another carrier or provider’s acceptable-use requirements.
5.2 SMS/MMS
Customers using SMS or MMS must obtain legally sufficient consent from recipients where required.
Customer may not send unsolicited messages or use purchased, rented, borrowed, scraped, or otherwise improperly obtained telephone-number lists.
Customer must honor valid opt-out requests such as STOP or UNSUBSCRIBE.
Customer may be required to complete carrier, industry, or campaign registration before messaging functionality is activated.
Certain messaging categories may be prohibited or restricted by Mary Mobile, its underlying providers, wireless carriers, industry registries, or applicable law.
6. FAIR AND REASONABLE USE
Mary Mobile Standard User plans are designed for ordinary commercial and residential communications use and are not intended for unusually high-volume or automated traffic.
6.1 Standard User Calling
Standard User outbound calling is subject to a fair-use threshold of 2,000 outbound minutes per Standard User per month, pooled across the Customer’s Standard Users.
Usage exceeding the applicable threshold will be billed at:
$0.04 per additional outbound minute.
6.2 Low Use Users
Where Mary Mobile expressly offers an approved Low Use User plan, combined inbound and outbound calling is subject to the applicable Low Use limits disclosed for that Service.
Mary Mobile may convert a user exceeding applicable Low Use thresholds to a Standard User plan or assess applicable usage charges.
6.3 SMS/MMS Thresholds
Unless otherwise stated in Customer’s service order:
- Standard Users are subject to a pooled allowance of up to 250 outbound SMS message segments per user/month.
- Standard Users are subject to a pooled allowance of up to 50 outbound MMS message segments per user/month.
Usage exceeding included thresholds may be billed at Mary Mobile’s then-current retail messaging overage rates.
Applicable carrier, campaign, registration, pass-through, or third-party messaging fees may also apply.
6.4 Prohibited High-Volume Uses
Unless expressly approved in writing, Service may not be used for:
- Spam or message blasting
- Bulk voicemail or fax broadcasting
- Bulk call-in services
- 900-number services
- Automated or predictive dialing
- Continuous machine-generated calling
- Call-center traffic inconsistent with the purchased service
- Monitoring or intercom applications inconsistent with the purchased plan
Mary Mobile may review abnormal usage patterns and may assess usage charges, require a different service plan, restrict traffic, suspend Service, or terminate Service where reasonably necessary to protect the network, comply with law, or enforce these Terms.
7. UNSUPPORTED USES
Mary Mobile VoIP Service is not intended to replace a traditional POTS line for:
- Fire alarm systems
- Security alarm systems
- Medical monitoring equipment
- Payment terminals
- Elevator emergency lines
- Other systems requiring continuous traditional telephone-line functionality unless expressly supported in writing
Customer assumes responsibility for determining whether the Service is appropriate for a particular application.
8. E911 AND EMERGENCY CALLING
VoIP 911 and E911 differ from traditional wireline telephone service.
Customer acknowledges that VoIP emergency calling depends upon Internet connectivity, electrical power, correct location information, properly configured equipment, and third-party emergency-routing systems.
8.1 Registered Location
Customer must provide and maintain accurate emergency location information for each applicable Service or device.
Customer is responsible for updating the Registered Location whenever equipment or Service is moved.
Customer should be prepared to provide the emergency operator with the caller’s actual physical location.
8.2 Internet Failure
VoIP calling, including 911, may be unavailable during loss of Internet connectivity.
8.3 Power Failure
VoIP Service may not operate during a power outage unless Customer maintains functioning backup power for all required equipment and Internet connectivity.
8.4 Equipment Relocation
Moving a VoIP telephone or other endpoint without updating its Registered Location may cause a 911 call to be routed to an incorrect emergency-response center or provide incorrect location information.
8.5 Emergency-Service Acknowledgment
Where required, Mary Mobile may require Customer to affirmatively acknowledge receipt and understanding of applicable 911/E911 limitations before Service is activated.
Customer agrees to notify all users of the Service of applicable 911 limitations and to place any required warning labels on or near equipment.
9. TELEPHONE NUMBERS AND PORTING
Telephone-number availability is not guaranteed.
Mary Mobile may assign telephone numbers subject to availability through its underlying providers.
Customer requesting transfer of an existing telephone number must provide accurate authorization and documentation.
Number-porting requests may be rejected or delayed because of inaccurate information, carrier requirements, third-party provider actions, regulatory requirements, unpaid obligations to another provider, or other matters beyond Mary Mobile’s reasonable control.
Customer should not cancel existing telephone service until Mary Mobile confirms that a requested port has been completed.
10. PRICING AND BILLING
Customer shall pay the rates specified in the applicable Mary Mobile service order, quote, product page, invoice, or pricing schedule.
10.1 Monthly Billing
Recurring charges are billed through Mary Mobile’s telecommunications billing platform.
10.2 Taxes and Regulatory Charges
Customer is responsible for applicable:
- Federal taxes
- State taxes
- Local taxes
- E911 charges
- Universal Service-related assessments
- Regulatory charges
- Other governmental or telecommunications-related assessments
Such charges may change during Service as required by law, regulation, governmental action, or changes in applicable cost.
10.3 Usage and Overage Charges
Usage exceeding included plan allowances will be billed at the applicable Mary Mobile retail rate.
For Standard User outbound calling exceeding the applicable pooled fair-use threshold, Mary Mobile’s current retail overage rate is:
$0.04 per minute.
10.4 Billing Disputes
Customer must notify Mary Mobile of a disputed telecommunications charge within 30 days after the applicable invoice unless applicable law provides a longer period.
Mary Mobile may request supporting information reasonably necessary to investigate the dispute.
11. EQUIPMENT AND INSTALLATION
Equipment, professional installation, cabling, network work, technician dispatch, configuration, travel, and other on-site services are not included in the advertised monthly plan price unless expressly stated.
Customer will be advised of applicable installation or equipment charges before such separately billable work is performed.
Customer is responsible for maintaining Customer-owned equipment and Internet/network services.
12. SERVICE AVAILABILITY AND INTERNET DEPENDENCY
VoIP Service depends upon broadband Internet connectivity and properly functioning equipment.
Mary Mobile does not guarantee uninterrupted or error-free Service.
Service quality may be affected by:
- Customer Internet connection
- Local network configuration
- Electrical outages
- Customer equipment
- Internet congestion
- Third-party networks
- Underlying carrier outages
- Maintenance
- Force majeure events
- Other circumstances beyond Mary Mobile’s reasonable control
Mary Mobile will use commercially reasonable efforts to address Service issues within its control.
13. FRAUD, SECURITY AND UNAUTHORIZED USE
Customer is responsible for protecting passwords, SIP credentials, portals, telephones, PBX systems, networks, and other Service credentials.
Customer is responsible for charges resulting from use of Customer’s account except where prohibited by applicable law.
Customer must promptly report suspected unauthorized use.
Mary Mobile may restrict or suspend Service where reasonably necessary to prevent fraud, abuse, unauthorized access, network harm, or substantial financial exposure.
14. SUSPENSION AND TERMINATION
Mary Mobile may suspend or terminate Service for:
- Nonpayment
- Material breach of these Terms
- Fraud or suspected fraudulent activity
- False customer information
- Unlawful use
- Failure to complete required verification
- Material violations of the Acceptable Use Policy
- Regulatory or government requirements
- Activity materially threatening Mary Mobile or an underlying provider’s network
Where commercially reasonable and legally permitted, Mary Mobile may provide Customer an opportunity to cure the violation.
15. REGULATORY CHANGES
Telecommunications services are subject to federal, state, and local regulatory requirements that may change.
Mary Mobile may modify rates, taxes, surcharges, compliance requirements, or Service terms when reasonably necessary to respond to changes in law, regulation, carrier requirements, industry rules, or regulatory assessments.
16. WARRANTIES AND LIMITATION OF LIABILITY
Except where prohibited by law, Service is provided on an “AS IS” and “AS AVAILABLE” basis.
Mary Mobile does not warrant that Service will be uninterrupted, error free, or available during every power, Internet, equipment, carrier, or network failure.
To the fullest extent permitted by applicable law, Mary Mobile will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from Service interruptions, loss of communications, data loss, Internet failures, Customer equipment failures, unauthorized use, or circumstances outside Mary Mobile’s reasonable control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
17. THIRD-PARTY AND UNDERLYING PROVIDERS
Mary Mobile may provide Services using telecommunications carriers, cloud-service providers, software vendors, numbering providers, emergency-service providers, equipment vendors, and other third parties.
Customer acknowledges that certain Service functionality depends upon such third parties.
Customer shall comply with applicable provider rules and technical requirements communicated by Mary Mobile.
18. INDEMNIFICATION
To the extent permitted by law, Customer agrees to indemnify and defend Mary Mobile and its officers, employees, affiliates, agents, contractors, and service providers against third-party claims arising from Customer’s unlawful use, fraud, prohibited traffic, violation of messaging laws, misuse of Service, or material violation of these Terms.
19. CHANGES TO SERVICE TERMS
Mary Mobile may update these Terms when reasonably necessary for operational, regulatory, legal, network, provider, or security reasons.
Material changes affecting Customer’s Service will be communicated as required by applicable law.
20. GOVERNING LAW AND DISPUTES
Any governing-law, venue, arbitration, class-action waiver, or dispute-resolution provisions applicable to Mary Mobile Service shall be set forth in the applicable customer agreement or service order and are incorporated into these Terms where applicable.
21. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
22. ENTIRE AGREEMENT
These Terms, together with Customer’s service order or quote, Mary Mobile’s Privacy Policy, E911 disclosures, Acceptable Use Policy, equipment terms, installation terms, applicable billing terms, and other incorporated service documents constitute the agreement governing Customer’s Mary Mobile VoIP Service.

Certain features, calling destinations, SMS/MMS usage, toll-free minutes and other services may have limits or additional charges. VoIP service may not function during internet, power or network outages.
